These Terms of Use are entered into by and between you and Emino World Limited and its affiliated entities (“EMINO WORLD”, “we”, or “us”). Together with any documents they expressly incorporate by reference, they govern your access to and use of this website, including any content, functionality and services offered on or through it (the “Website”), whether as a guest or a registered user. By using the Website, you accept and agree to be bound by these Terms of Use. If you do not agree, you must not access or use the Website.
01 — Changes to the Terms of Use
We may modify, alter or update these Terms of Use at any time, and any such change is effective immediately upon our posting of the revised terms on the Website. Your continued access or use of the Website following any change constitutes your acknowledgement and acceptance of the amended Terms of Use.

Creative work, campaigns and case studies presented on the Website may include materials produced for or with our clients and remain the property of their respective owners.
04 — Trademarks
The EMINO WORLD name and logo, and all related names, logos, product and service names, designs and slogans, are trademarks of EMINO WORLD or its affiliates. You must not use these without our prior written permission. All other names, logos and marks are the trademarks of their respective owners. You may not modify, copy, reproduce, distribute, transmit, display, publish, sell, license or create derivative works from any content on the Website for commercial or public purposes without our written consent.
05 — Disclaimer of warranties
The information, materials and services on the Website are provided “as is” and “as available”, without warranty of any kind, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, title, non-infringement and accuracy. We do not warrant that the Website, its content or any services obtained through it will be accurate, reliable, error-free or uninterrupted, that defects will be corrected, or that the Website or its server is free of viruses or other harmful components. 08 — Governing law and jurisdiction
All matters relating to the Website and these Terms of Use, and any dispute or claim arising therefrom or related thereto (including non-contractual disputes or claims), shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region, without giving effect to any choice or conflict of law provision or rule.
09 — Dispute resolution
Any dispute arising out of or in connection with these Terms of Use, including any question regarding its existence, validity or termination, shall be referred to and finally resolved by arbitration administered by the Hong Kong International Arbitration Centre (HKIAC) under the HKIAC Administered Arbitration Rules in force at the time. The seat of arbitration shall be Hong Kong and the language of the arbitration shall be English.
10 — Limitation on time to file claims
Any cause of action or claim you may have arising out of or relating to these Terms of Use or the Website must be commenced within one (1) year after the cause of action accrues; otherwise, such cause of action or claim is permanently barred.
11 — Waiver and severability
No waiver by EMINO WORLD of any term or condition set out in these Terms of Use shall be deemed a further or continuing waiver of that or any other term or condition, and any failure to assert a right or provision shall not constitute a waiver of it. If any provision is held invalid, illegal or unenforceable, it shall be eliminated or limited to the minimum extent such that the remaining provisions continue in full force and effect.
12 — Entire agreement
These Terms of Use and our Privacy Policy constitute the sole and entire agreement between you and EMINO WORLD regarding the Website, and supersede all prior and contemporaneous understandings, agreements, representations and warranties, both written and oral, regarding the Website.

任何因本使用條款引起或與之相關的爭議，包括有關其存在、效力或終止的任何問題，均應提交香港國際仲裁中心（HKIAC），並按提交仲裁時有效的《HKIAC 機構仲裁規則》進行仲裁並作最終解決。仲裁地為香港，仲裁語言為英文。
10 — 申索時限
閣下 因本使用條款或本網站而擁有的任何訴因或申索，必須於訴因產生後一（1）年內提出；否則，該訴因或申索將永久失效。
11 — 棄權與可分割性
EMINO WORLD 就本使用條款任何條款所作的棄權，概不視為對該條款或任何其他條款的進一步或持續棄權；未主張任何權利或條款，亦不構成對該權利或條款的棄權。若任何條款被裁定為無效、不合法或不可執行，該條款將於最低必要範圍內被剔除或限制，而其餘條款仍將完全有效。
12 — 完整協議
本使用條款連同我們的私隱政策，構成 閣下 與 EMINO WORLD 就本網站的唯一及完整協議，並取代所有先前及同期就本網站的書面或口頭理解、協議、陳述與保證。
